SC CASE AGAINST CHAMLING DEFERRED TILL AUGUST

SDF requests public not be swayed by the Opposition propaganda campaign

GANGTOK, May 14: The disproportionate assets case filed by the Opposition Sikkim Pradesh Congress Committee (SPCC) in the Supreme Court against the Chief Minister and ruling Sikkim Democratic Front (SDF) Party president, Pawan Chamling, was heard today in New Delhi.

According to reports reaching here, the Supreme Court has listed the case for the last week of August 2007.

A press release issued by the SDF party headquarters says that the case, which is at the stage of notice, was listed today and it was brought to the notice of the Court that the pleadings in the case are more or less complete. Accordingly, Justice CK Thakkar and Justice A Kabir passed an order for hearing during the last month of August on a non-miscellaneous day later this year.

Following this development, SDF has said that despite the matter pending in the Court, the Opposition parties have been “spreading false propaganda with the sole objective to disturb the peace in the State.” “With this kind of misinformation campaign the Opposition parties are making every effort to mislead the people and create disturbance in the State. The SDF party request the general public not to be misled by such false propaganda instigated by the Opposition parties which are politically motivated,” the press release said.

The Congress, on the other hand, seemed to be in a celebratory mood, deeming this development as some minor victory.

It may be recalled here that four members of the Sikkim Congress Committee ( KN Lepcha and Others) had filed a writ petition against Chief Minister Pawan Chamling, the Union Government and the State Government of Sikkim in the Supreme Court on July 27, 2006. On August 14, 2006, the case was admitted by the Supreme Court which issued Notices to all the Respondents.

The Constitutional Bench of the Supreme Court of India consisting of Chief Justice, YB Sherbawal and two Judges had heard the Writ Petition (c) No. 353 of 2006 pertaining to “possession of wealth beyond known source of income and misappropriation of public funds.”

The Congress had earlier claimed that the Writ Petition was filed to “protect the interests of not only the citizens of Sikkim but also the entire country, whose hard-earned money as part of the public exchequer, was allocated to Sikkim for its development.”

The petitioners had appealed to the Supreme Court for a CBI inquiry into the case.

The Congress had made use of Part B of the 10th Schedule of the Constitution (35th Amendment) Bill, 1974, clause 2 (i) (c) which impeaches anyone holding the office of power for misappropriation of funds either by himself and /or through his family members, friends, associates and nominees and corrupt practices knowing no bound and misusing the power and the office of the Chief Minister of the State and treating the entire Government machinery as their own and by the means thereof, have swindled acquired and amassed huge wealth and properties grossly disproportionate to their known sources of income and continuing to do so at the cost of the people.”

    My state Sikkim is slowly getting corrupted, the politicians in the
    past were no doubt corrupt, but I guess the politician next in line is
    more of an “upgraded” version (corruption wise!).. if the previous politicians were DOS Chamling is the upgrade version of Windows Vista!
    He is a hypocrite –and every educated mass of Sikkim knows it.
    But nobody wants to say anything –cause the income of the Sikkimies people (Government servants) are directly or indirectly through the government.
    I think the media should also concentrate more on Sikkim also,
    Chamling has been ruling like a dictator –and I hope and pray he is
    Kicked out soon! The people of north Sikkim have been under hunger strike since
    Eternity, (ACT), protesting against the hydro project… its effect on ecology is just

  2. This is what WILL happen to Sikkim:-

    Destruction of the eco system, and thus the fragile environment of Sikkim.

    Lepchas who have sold some parts of their land will make ugly square shaped buildings.

    Thus North Sikkim,the once true identity of Sikkim, will be just another concrete jungle.

    Lepchas will lease their "buildings" to outsiders, most probably Bengalis.

    The building will attract low budget tourist, who will further create havoc to the environment.

    Mr... oh sorry.. DOCTOR Chamling just might built another Statue or he could get more ambitious and built a Pyramid, for the North Sikkim People!

    Ultimately Sikkim will be "the land of Statues".... scant lush green vegetation and sweet cool breeze!

    While the plains men will be doing their stage One and Two and Three .. in the river...
    the non local IAS and IPS doing their bossing around and ofcourse singing Lepcha and other Sikkimies songs and dancing around too!
    ....Some brave Sikkimies will be trying their best to do "Business" with the Chinese... oh but the road just got washed away by a land slip..darn Business is bad!

    Frustrated Engineers,Doctors, Govt employees ..the cream jing-bang will leave the "Land of Statues."

    Unemployed youths will feel worse, they will join politics and violence...
    departments will stink of corruption, cause the officers will merely be puppets(a reality now)... contract will be only for the privileged few with "special connections/reference" (reality now)

    Sikkim will be in debt (Reality now).. .
    ...communal Violence and chaos..

    The Gang and
    Doctor Chamling,
    (who due to the wonders of plastic surgery, will be rid of his ugly face.. )
    will be doing the Hoola-hoopa in some fancy Island.
    As for the ACT heros...they will still be in front of the BL house with pipes shuved through their nose...
    Or MAYBE this won't happen...

    The Bad guys are going to be kicked out, "The Doctor Chamling" is going to be punished by the CBI (but again he's got holds..) or most likely by GOD... thus getting struck by a lightning!
    And Sikkim will concentrate on eco-tourism and preservation of its wonderful asset: Nature.
    And everybody will live happily ever after... (Sounds like a fairy-tale)...

    But I seriously Salute the brave protestors.. you all did make a start..and are making a difference.. now win or lose... you will not be held responsible..
    you will not be called the destroyers of Sikkim...I pray that five years from now .. Sikkim will be Sikkim.. work towards success..keep the fight alive ACT!
